Every graduate of the Bachelor of Laws (LLB) programme is required to successfully undertake and pass a course in Jurisprudence.
Under the course of Jurisprudence, one of the core topics is the "Schools of Law or Jurisprudence".
One of which is the "Sociological School of Law".
One of the key proponents is Dean Roscoe Pound.
"Nathan Roscoe Pound (1870–1964) was a pioneering American legal scholar, educator, and founding father of the "sociological jurisprudence movement.
Over his extensive career, he served as the Dean of the University of Nebraska College of Law and, most notably, as the Dean of Harvard Law School from 1916 to 1936.
Pound fundamentally changed legal education and philosophy by arguing that the law should adapt to the social and economic needs of the modern world."
"Roscoe Pound's theory of law, widely known as Social Engineering, views the legal system as an active tool designed to balance competing human interests and maximize the satisfaction of societal wants with the least amount of friction and waste."
Manupatra wrote that
"Roscoe Pound—one of the most prominent figures in the Sociological School of Jurisprudence—likened jurists, legislators, and judges to "social engineers" who deliberately structure society through law."
Wike, Hon. Kingsley Ogundu Chinda, Hon. Justice Omotosho and Hon. Justice Adah, JSC, have one thing in common: they are all lawyers that successfully undertook the Bachelor of Laws (LLB) programme at different time periods.
The quartet also successfully completed the mandatory and compulsory course in Jurisprudence, therefore the four of them must be aware of Dean Roscoe Pound's Sociological Jurisprudence of using the instrument of law as a tool for social engineering.
However, it appears that instead of using the law as an instrument for social engineering, this quarter is using the law as an instrument of "Reverse engineering" social engineering of Nigeria's democracy as .set out under Sections 130, 224 to 228 of the Constitution of the Federal Republic of Nigeria, 1999.
Section 130 of the Nigerian Constitution clearly set out that Nigeria's democracy is a presidential system of government modelled after the United States of America. Wike has altered this Section of the Nigerian Constitution by his formation of a so-called Rainbow coalition of minority political parties in Rivers State which seeks to present only one presidential and governorship candidates for the 2027 general elections.
The referenced sections (224 to 228) of the Nigerian Constitution also sets the institutional framework for political parties in Nigeria including the majority and minority political parties and how they are to function and co-exist and be regulated by the Independent National Electoral Commission-INEC.
Instead of using the law as an instrument of social engineering, the quartet of Wike, Chinda, Omotosho J. and Adah, JSC (by both their recent actions and judgments) are using the law as an instrument of "reverse engineering" of the referenced sections of the Nigerian Constitution.
"Reverse Engineering" is "the process of deconstructing or analyzing a product, system, or software to understand how it works."
By both their words and recent judgments, these four lawyers have shown themselves to be like amateur mechanics and not skilled engineers whom the late Dean Roscoe Pound envisaged to use the instrument of the law for the benefits of the greater number of the citizens through the process of social engineering.
Wike and Chinda's use of law as an instrument of social engineering (reverse engineering) is aimed at promoting the personal and joint ambition of control of political power in Rivers State through the violation of Sections 77, 82 to 88 of the Electoral Act, 2026 which resulted in the emergence of Hon. Chinda as the governorship candidate of the All Progressives Congress?APC) in Rivers State. Whereas since the year 1998, the said Chinda had remained a prominent member of the People's Democratic Party (PDP).
On their parts, both Omotosho J. and Adah, JSC (Justice of the Supreme Court of Nigeria) recently delivered judgments that touched on the Electoral Act, 2026 and the PDP in Nigeria.
Suffice to say that instead of their judgments providing sanity and orderliness within the democratic and ecosystem of political parties within as is expected of the correct use of law as an instrument of social engineering. Their judgments brought more chaos and "reverse engineering".
In the final analysis, if Dean Roscoe Pound and other proponents of the Sociological Jurisprudence or Sociological School of Law were to visit Nigeria of today and see how these four men are misapplying their theory, they would weep unconsolably!!!
Yours faithfully,
Dr. Tonye Clinton Jaja, SCN is the Executive Secretary of the Incorporated Trustees of ALDRAP, Legislative Lawyers of Nigeria.
